Terms of Service

Effective October 1, 2026

These terms govern your use of Claym (getclaym.com, the Claym dashboard and related services). Claym is operated by Apparition Content ("Claym," "we," "us"). By creating an account, buying a zip or using the dashboard, you agree to these terms on behalf of yourself and the business you represent ("you").

1. What Claym is

Claym provides property and contact intelligence for roofing, HVAC and other home-services contractors. You subscribe to one or more zip codes for a trade. For as long as your subscription is active and paid, we don't sell the same zip and trade to another company.

2. Plans and billing

3. Your account and team

You're responsible for your account, the team members you add, and everything done under those logins. Keep passwords private. One login per person.

4. Our data

The information in Claym is compiled from public records, government and weather sources, and licensed third-party data providers, and is collected and used in compliance with applicable law. We work to keep it accurate, but records lag and circumstances change. All data is provided "as is," without any guarantee that it is complete, current or correct, or that any lead will result in work.

5. Your outreach is your responsibility

Claym gives you information. How you use it, including who you contact, how, and how often, is entirely up to you and your team, and so is following the law. You agree to comply with all laws and rules that apply to your outreach, including the Telephone Consumer Protection Act, the National Do Not Call Registry and state do-not-call and telemarketing laws, CAN-SPAM, local solicitation and door-to-door ordinances, and HOA and property rules.

Do-not-call flags in Claym are a convenience, not legal advice or a guarantee. Claym is not responsible for any call, text, email, visit or other contact you or your team make, or for how often you make them. That includes repeated or unwanted contact with homeowners, HOA boards, management companies or anyone else. You agree to defend and indemnify Claym against any claims, fines or costs arising from your use of the data or your outreach.

6. What you can't do

We may suspend or close accounts that break these rules, without a refund.

7. Ownership

Claym, the dashboard, the scores and the compiled data belong to us or our licensors. While your subscription is active, you get a limited, non-transferable license to use them for your own business. Your notes and lead outcomes belong to you.

8. Limitation of liability

To the fullest extent the law allows, Claym is not liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or business. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim arose.

9. Ending the service

You can cancel as described in section 2. We may end or suspend the service for non-payment or a breach of these terms. Sections 4 through 8 and 10 continue to apply after the service ends.

10. General

These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. We may update these terms; we'll post the new version here, and for material changes we'll email account owners at least 30 days before they apply. If any part of these terms is unenforceable, the rest still applies.
